Terms of service
Terms for the electronic services provided through the qmedic.io website.
This is a translation provided for convenience. The binding version is the Polish one: Regulamin serwisu.
§ 1. Who provides the services
The provider and owner of the qmedic.io website is:
ul. Szlachecka 19, 30-444 Libertów, Poland
NIP 9442300011 · REGON 544080503 · KRS 0001226410
kontakt@qmedic.io · +48 533 115 319
These terms set out the rules for using the website and are issued under Article 8(1)(1) of the Polish Act of 18 July 2002 on the provision of services by electronic means.
§ 2. Definitions
| Term | Meaning |
|---|---|
| Website | the site available at qmedic.io, including its subpages |
| Provider | QMedic Sp. z o.o., identified in § 1 |
| User | anyone who uses the Website |
| Service | a service provided by electronic means, described in § 3 |
| Form | the contact form made available on the Website |
§ 3. What services are provided
The Provider supplies two services by electronic means, both free of charge:
- Access to Website content — browsing information about the Provider's activity and its advisory and delivery services.
- Contact form — sending an enquiry and receiving a reply at the email address provided.
The Website sells nothing, accepts no payments, creates no user accounts and provides no paid content. Material published on the Website is informational and does not constitute an offer within the meaning of Article 66 § 1 of the Polish Civil Code.
Sending an enquiry through the Form obliges neither party to enter into a contract. Any terms of cooperation are agreed separately.
§ 4. What you need in order to use the Website
Using the Website requires only:
- a device with internet access,
- a current web browser with JavaScript enabled,
- for the Form — a working email address.
The Website does not require cookies to be enabled, because it uses none. Disabling JavaScript will prevent the Form from being sent; the Website content remains available.
The Provider notes that using the internet involves the usual risks, such as unauthorised access to data in transit or malicious software. Keeping software and anti-virus protection up to date is recommended.
§ 5. When the agreement begins and ends
The agreement for access to Website content is concluded when you enter the Website and terminates when you leave it. No further action is required.
The agreement for the Form service is concluded when the Form is submitted and terminates once a reply has been given or once the retention period for the enquiry, set out in the Privacy policy, has elapsed.
You may stop using the Website at any time at no cost.
§ 6. What is not allowed
Users are prohibited from supplying unlawful content. In particular, it is forbidden to:
- send content through the Form that breaches the law, good practice or the rights of third parties,
- send unsolicited commercial communications (spam),
- submit other people's personal data without their consent,
- interfere with the operation of the Website, including sending automated requests in order to load its infrastructure,
- circumvent the Website's technical safeguards.
The Provider may refuse to handle an enquiry that breaches these rules.
§ 7. Copyright
The content of the Website — text, graphics, video, layout and code — is subject to the Provider's exclusive rights or is used under appropriate licences, and is protected by copyright.
Using the Website transfers no rights to that content to the User. Copying, distributing or using it for commercial purposes without the Provider's written consent is not permitted. Personal use and quotation within the limits set by copyright law remain permitted.
§ 8. Complaints
Complaints about the Website or the Services may be sent to kontakt@qmedic.io.
A complaint should describe the problem and include contact details that allow a reply. The Provider examines the complaint and responds within 14 days of receiving it, to the email address it was sent from.
§ 9. Personal data
How personal data is processed, including data submitted through the Form, is described in a separate document: Privacy policy.
§ 10. Consumers
The Website is addressed to businesses. Where a consumer within the meaning of Article 22¹ of the Polish Civil Code uses the Website, these terms do not limit the rights granted to that consumer by mandatory provisions of law. In the event of conflict, statutory provisions prevail.
Consumers may use out-of-court complaint and redress procedures, including assistance from a district or municipal consumer ombudsman and the online dispute resolution platform at ec.europa.eu/consumers/odr.
§ 11. Liability
The Provider makes every effort to keep the Website running but does not guarantee uninterrupted availability. The Website relies on third-party infrastructure listed in the Privacy policy, and outages on their side may affect its availability.
Informational content on the Website does not constitute legal, tax or investment advice. Decisions taken on the basis of it are taken at the User's own risk.
The limitations above do not exclude the Provider's liability to the extent that excluding it is not permitted under applicable law.
§ 12. Changes to these terms
The Provider may amend these terms, in particular where the scope of services, the law or technical arrangements change. Amended terms are published on the Website stating their effective date and apply from that date. Earlier versions are available on request.
§ 13. Governing law
Matters not covered by these terms are governed by Polish law, in particular the Civil Code, the Act on the provision of services by electronic means and the Act on copyright and related rights.
Disputes with Users who are not consumers are settled by the court having jurisdiction over the Provider's registered office. Disputes with consumers are settled by the court determined under general rules.
